SCOTUS Declines Trump’s Request in Documents Case

The recent FBI raid on the former president’s Mar-a-Lago estate is still being contested in the nation’s courts. Trump’s legal team’s request to the US Supreme Court on October 4 is the latest development in the dispute. They requested that the Justices grant special master access to the sensitive documents found during the event. The Department of Justice (DOJ) had previously been permitted to withhold by the 11th Circuit Court.

The Supreme Court denied the request on October 13. According to the SCOTUS blog, the Justices did not give any justification for their decision to refuse admission.
The arbitrator examines the documents seized to see if they fall under the executive privilege or attorney-client privilege. The former president has asked special master Judge Raymond Dearie to conduct an independent examination; however, the review excludes the sensitive papers. Judge Dearie will present a written recommendation to the district court for the ultimate handling of any contested documents following his review.

Trump’s legal team argued in the Supreme Court appeal that Dearie’s capacity to perform his duties would be compromised by the 11th Circuit Court’s decision to let the FBI withhold sensitive documents. Furthermore, they maintained that withholding information would damage the legal system’s legitimacy.

According to CBS News, the DOJ stated that Trump has no right to the confidentiality of any secret information. Thus those documents are not subject to the special master’s scrutiny.
